By downloading, installing, or using SleepNoize ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices that you own or control.

3. Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any proprietary notices from the App
• Use the App for any illegal purpose
• Rent, lease, lend, sell, or redistribute the App

4. Medical Disclaimer

Important: SleepNoize is a wellness app designed to help with relaxation and sleep. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

• Binaural beats and sound therapy are not substitutes for medical treatment
• If you have a medical condition, consult your doctor before use
• Do not use while driving or operating machinery
• Reduce volume if you experience any discomfort

5. Intellectual Property

The App and all its content, features, and functionality are owned by SleepNoize and are protected by international copyright, trademark, and other intellectual property laws.

6. App Store Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and SleepNoize, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product liability claims
• Apple is a third-party beneficiary of these Terms

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SLEEPNOIZE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or other harmful code
• Any content or conduct of any third party

9. Purchases and Refunds

All purchases are processed through the Apple App Store. Refunds are subject to Apple's refund policy. We do not have access to your payment information or the ability to process refunds directly. Please contact Apple Support for refund requests.

10. Updates and Changes

We may update the App from time to time to add features, fix bugs, or improve performance. These updates may be automatic or may require you to manually update.

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

12. Governing Law
